Scope of Agreement
These Terms of Service ("Terms") govern the use of virtual private server services, web hosting services. ("Services") Provided by BlastVPS, operated by BlastVPS. By ordering, accessing, or using any Service, the customer ("Client") agrees to be bound by these Terms. Deviating conditions do not apply unless explicitly agreed to in writing.
Services Provided
a) Scope of Services: BlastVPS provides virtual server infrastructure, including CPU, memory, storage, and network access, to the Client on a subscription basis. The Services are provided without software support unless explicitly stated in writing.
b) Service Modifications: BlastVPS reserves the right to modify, replace, or discontinue any Service, that is breaching our Terms of Service.
Account and Access
b) The Client is fully responsible for all activities conducted via their credentials and must implement reasonable security measures to prevent unauthorized access.
c) Misuse of access credentials or compromise of system security may result in suspension or termination without prior notice.
Payment and Invoicing
b) Invoices are issued upon order confirmation and must be paid before activation. Services are typically delivered within 24 hours of receipt of cleared payment.
c) Failure to pay by the due date may result in service suspension. After 72 hours of non-payment, the Service may be terminated and all associated data permanently deleted.
d) BlastVPS may adjust pricing with a minimum notice period of 6 weeks.
Service Availability and Maintenance
b) Scheduled maintenance shall be announced at least 24 hours in advance and shall not exceed 24 hours per month, unless critical or unforeseeable.
c) In the event of downtime not attributable to force majeure or third-party failures, service credits may be issued at BlastVPS's discretion.
Term, Termination, and Cancellation
b) The Client may cancel the contract at any time before the next billing cycle. No refunds are issued for unused portions of the active period.
c) BlastVPS may terminate the contract immediately if:
- The Client materially breaches these Terms.
- Payment is overdue beyond the grace period.
- Required by court order or legal obligation.
Right of Withdrawal (Consumer Clients Only)
If the Client is a consumer within the meaning of applicable EU law, they may cancel the contract within 2 days of activation without stating a reason. If the Client explicitly requests service activation before the 14-day withdrawal period expires, a proportional charge may apply based on usage until the cancellation date.
Liability and Warranty
b) The maximum liability in any case shall not exceed the amount paid by the Client in the three (3) months preceding the incident.
c) The Client is solely responsible for backing up data and securing their systems.
Data Protection and Confidentiality
BlastVPS processes personal data in compliance with the General Data Protection Regulation (EU) 2016/679 ("GDPR") and relevant national legislation. Client data is not accessed, transferred, or analyzed by BlastVPS personnel unless strictly required for technical maintenance or by legal obligation. The Client consents to the processing of necessary account and billing information for the performance of the contract.
Force Majeure
Neither party shall be liable for failure or delay in performance due to events beyond its reasonable control, including but not to limited to natural disasters, war, cyberattacks, embargoes, power outages, or government actions.
Jurisdiction and Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kingdom of Belgium.
Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. An invalid clause shall be replaced by a valid one that best reflects its economic purpose.
Amendments
BlastVPS reserves the right to amend these Terms with effect for the future. Amendments shall be communicated to the Client at least 30 days in advance. Continued use of the Services constitutes acceptance of the revised Terms.
Acceptable Use and Restrictions
The Client shall not use the Service for any of the following:
- Operation of malicious infrastructure (e.g., botnets, ransomware).
- Unauthorized port scanning, spoofing, or denial-of-service attacks.
- Distribution or storage of illegal content or software.
- Infringement of intellectual property rights.
- Spamming or mass unsolicited communications.
- Hosting content that promotes hate, violence, or criminal activity.
- Hosting or distributing materials involving child sexual abuse.
Breach of this section may result in immediate service termination and permanent ban without refund or prior notice.
